Resumen

Aunque la discriminación por antecedentes penales es ilegal en Nueva York, muchos empleadores aún filtran a quienes buscan trabajo con base en sus posibles sentencias previas. Realizamos un estudio en los hospitales estatales para analizar el uso de historiales judiciales en la evaluación de aplicaciones en línea para empleo. Dos tercios de estos procedimientos incluyeron preguntas respecto a sentencias previas, esta práctica, que fue más común en medios suburbanos y rurales, puede privar a los ex-convictos y a sus comunidades de los múltiples beneficios de un empleo. Abstract Although discrimination on the basis of previous incarceration is illegal in New York, many employers still screen job applicants based on prior convictions. We conducted a study of New York State hospitals to examine the use of incarceration histories in online applications. Two-thirds of NYS hospitals asked questions about convictions. This was most common in hospitals located in suburban and rural areas. This practice may deny returning prisoners and their communities the numerous benefits of employment.
